Terms of Service

These Terms of Service (“Terms”) govern your use of the Mountain High Disposal mobile application (the “App”). The App is provided by Mountain High Disposal (“MHD,” “we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Purpose of the App

The App provides convenient access to collection schedules, disposal guidance, service information, reminders, contact options, and links to billing or service-request resources. The App is an informational and communication tool; it does not replace a customer’s separate service agreement, account terms, invoices, posted rules, waivers, or direct notices from MHD.

2. Address selection and accounts

The App does not require an App account. You may search for and select a listed service address so the App can display relevant information. Selecting an address does not establish residency, ownership, authorization to act for the property, a customer relationship, or a right to service. It does not change the customer of record or any existing MHD account.

You agree not to use address information to interfere with another customer’s service or to misrepresent your identity, authority, or relationship to an address.

3. Schedule and service information

Collection dates, accepted materials, service descriptions, and other information are provided for convenience. Routes and services can change because of weather, holidays, safety conditions, equipment, operational needs, account status, or other circumstances. Direct communications from MHD and the terms of an applicable customer agreement control if they conflict with information shown in the App.

You remain responsible for following current preparation, placement, safety, payment, and material-acceptance requirements. Contact MHD if information appears incorrect or if you need confirmation.

4. Notifications

Optional notifications are a convenience and may be delayed, blocked, or unavailable because of device settings, software behavior, connectivity, or other factors. You should not rely on a notification as the sole source of schedule information.

5. Requests, email, forms, and payments

An email, sign-up form, damage report, missed-pickup message, roll-off request, or other submission is a request only. Service is not scheduled, changed, or confirmed until MHD accepts or confirms the request. Additional eligibility requirements, charges, deposits, agreements, and waivers may apply.

Billing and payment features may be provided through an external portal. You are responsible for reviewing the amount, recipient, and applicable payment terms before completing a transaction. Questions about a payment should be directed to MHD or the identified payment provider.

6. External links and services

The App may link to websites, forms, documents, payment services, or other resources operated by MHD or third parties. Those resources may have separate terms and privacy practices. We are not responsible for third-party content, availability, security, or practices. A link does not imply endorsement of every statement, product, or service on the linked resource.

7. Acceptable use

You agree not to:

  • Use the App unlawfully, fraudulently, or to harm another person.
  • Attempt to gain unauthorized access to the App, its systems, data, or another user’s information.
  • Interfere with, overload, reverse engineer, scrape, or disrupt the App or its supporting services, except where applicable law expressly permits.
  • Introduce malicious code or use automated means that unreasonably burden our systems.
  • Copy, modify, distribute, or commercially exploit App content except as authorized by law or by MHD in writing.

8. Ownership

The App and its software, design, text, graphics, branding, and other content are owned by or licensed to MHD and are protected by applicable intellectual-property laws. Subject to these Terms, MHD grants you a limited, revocable, nonexclusive, nontransferable license to use the App for personal, lawful purposes related to MHD services.

9. Availability and disclaimers

To the fullest extent permitted by law, the App is provided “as is” and “as available.” We do not warrant that it will always be accurate, uninterrupted, secure, or error-free, or that every service address or feature will be available. The App is not an emergency service. For emergencies, call the appropriate public emergency service.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

10. Limitation of liability

To the fullest extent permitted by law, MHD and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, business, or opportunities arising from or related to the App. Our aggregate liability related to the App will not exceed the amount you paid specifically to use the App, if any.

These limitations do not apply where prohibited by law and do not alter liability or remedies under a separate customer service agreement.

11. Changes, suspension, and termination

We may update, add, remove, suspend, or discontinue App features at any time. We may restrict access if we reasonably believe use violates these Terms, threatens security, or creates legal or operational risk. You may stop using the App at any time by uninstalling it.

12. Changes to these Terms

We may revise these Terms as the App, our services, or legal requirements change. The revised Terms will be posted on this page with a new effective date. Continued use of the App after a revision constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute that is not governed by a separate written agreement will be brought in a court of competent jurisdiction in Colorado, except where applicable consumer law requires otherwise.

14. General terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any applicable separate agreement, contain the terms governing use of the App.
